DECISION OF THE BOARD; October 4, 2001
1Board File No. 1775-01-R is an application for termination of bargaining rights. In its response to that application Labourers’ International Union of North America, Local 1059 (referred to as the “union”) asks that the application be dismissed pursuant to section 63(16) of the Labour Relations Act, 1995 (the “Act”). Board File No. 1804-01-U is an application by the union under section 96 of the Act. The union’s allegations in the section 96 application include those contained in its response to the termination application.
2Woollatt Building Supply Limited asks that it be relieved of its obligation to file a response to the application in Board File No. 1804-01-U until the application in Board File No. 1775-01-R has been determined. The union asks that the two files be consolidated.
3The allegations contained in the union’s response to the termination application overlap with those contained in its application under section 63(16). It is therefore appropriate that the applications be heard together. The application in Board File No. 1804-01-U will therefore also proceed on the dates previously set for Board File No. 1775-01-R, October 29 and 30, 2001 at 9:30 a.m. in the “Boardroom” 2nd Floor, 505 University Avenue, Toronto.
4Woollatt Building Supply Limited’s request for an extension of the date by which it must file its response in Board File No. 1804-01-U is hereby denied.
