Decision of the Board
1By decision dated May 4, 2001 the Board directed the applicant and CUPE and its Local 148 to file their submissions with respect to the application for reconsideration made by the City of Greater Sudbury on or before May 14, 2001. Counsel for the applicant and CUPE and its Local 148 seeks a one week extension to May 21, 2001 within which to file submissions on the basis that she has been ill and out of the office for about the last three weeks and has only returned to work for partial days. She stated that she is involved in hearings on May 10, 11 and 14 and also advises that the national representative responsible for Locals 4705 and 148 is on vacation until May 16. Counsel submits that she cannot get instructions with respect to issues raised in the request for reconsideration until that time, at the earliest.
2Counsel indicated that she sought the consent of counsel for the City of Greater Sudbury to the extension and advises that counsel objected to the extension.
3The issue raised by the City of Greater Sudbury relates to the correct identity of the bargaining agents representing employees in three of the bargaining units fashioned by the Board in its March 20, 2001 decision. Counsel for the applicant and CUPE and its Local 148 acted promptly in seeking an extension and has provided reasonable grounds on which the Board could exercise its discretion. In my view, a delay of one week will not unduly prejudice any of the parties and therefore I am satisfied to extend the time for filing a response by the applicant and CUPE and its Local 148 to Tuesday May 22, 2001 (Monday May 21 is a holiday). Similarly, counsel for the City of Greater Sudbury may file its reply, if any to the submissions of the applicant and CUPE and its Local 148 on or before Monday, June 4, 2001.
