DECISION OF THE BOARD; July 18, 2001
1This is an application for certification filed under the construction industry provisions of the Labour Relations Act, 1995 (“the Act”).
2A decision ordering a representation vote was issued by the Board earlier today. That decision was based upon the application and the response received from the responding party, Queensgate Homes (Brooklin) Inc.
3Since that decision was issued a further response has been brought to the attention of the Board (it was not in the Board file at the time of issuing the first decision and appears to have been received by the Board only at 16:24 today). That response is from the responding party, Queensgate Homes (Lynde Shores) Ltd. It too includes notice under section 8.1 of the Act.
4The Board’s earlier decision will be varied only to a limited extent. The representation vote will still proceed and the ballots cast will not be counted, but sealed in the ballot box, as stated in the Board’s earlier decision. In addition, though, each ballot cast will be individually segregated.
