DECISION OF THE BOARD; September 28, 2001
- The parties have reached an agreement with respect to certain procedural matters relating to this application. The agreement provides as follows:

The parties signing below agree as follows:
Applicant will indicate which paragraphs of the 4 responses the Applicant does and does not agree with by Oct. 1, 2001.
Applicant will review the documents provided by the Responding Parties and will put together a list of the documents the Applicant intends to adduce of the hearing by Oct. 1, 01. This does not preclude the Applicant from seeking to adduce other documents at the hearing. The Applicant will provide each Responding Party with a book of those documents by Oct. 1, 2001.
The CCAC will proceed first, followed by the other Responding Parties, then the Applicant, then the Responding Parties in reply. The same order will be followed for cross examination.
The Responding Parties as signed below have produced documents pursuant to a Board order. For the purpose of the Hearing that has now been scheduled for this matter, the Responding Parties agree that the documents that they have produced to only the Applicant and the Board can now be disclosed only to the other Responding Parties if one party intends to rely on such a document. This agreement is strictly without prejudice to the Responding Parties’ position in this matter and in no way shall be used to the determent of the Responding Parties. The Applicant shall not use these documents for any purpose other than for this matter and will not disclose these documents or their contents in any way to any other entity.
The parties request that the Board endorse this Agreement.
