Decision of the Board
1This is an employee appeal of the refusal by an Employment Standards Officer to issue an Order to Pay.
2A hearing was held in Toronto on April 18, 2001.
3The appeal concerns the refusal by an Employment Standards Officer to issue an Order to Pay against 1312788 Ontario Limited under section 12 of the Employment Standards Act (“the Act”) for unpaid wages owed by Future Health Inc. o/a Trauma Services. The Officer’s refusal was based on the assertion that such a claim was statute-barred.
4Mr. Wolf filed an application for review of the Officer’s decision. However, it appears that 1312788 Ontario Limited was not listed as a potential responding party and accordingly did not receive formal notice of and did not attend the hearing.
5Since any decision would by necessity affect 1312788 Ontario Limited, the Board adjourned the hearing so that it could be notified.
6In order to facilitate appropriate notice, the Board directs Mr. Wolf to provide the Board with the address, telephone number and a contact person for 1312788 Ontario Limited. Once that information is received, the Board will notify 1312788 Ontario Limited and the other parties of a new hearing date.
