DECISION OF THE BOARD; May 22, 2001
1Counsel for Inco Limited (“Inco”), by letter dated May 16, 2001 advised the Registrar that Inco wished to withdraw its appeals in Board File Nos. 2646-00-HS, 2648-00-HS and 2941-00-HS. That letter also requested information with respect to whether notices of hearing have been issued by the Board in connection the proceedings involving Inco in Board File Nos. 2933-00-HS and 3035-99-HS. Counsel advises that two hearing days (June 20 and 21, 2001) had been set in Board File Nos. 2646-00-HS and 2648-00-HS but it appears that no hearing dates had been fixed in respect of the other matters referred to in his letter.
2The Board has reviewed Board File Nos. 2646-00-HS, 2648-00-HS and 2941-00-HS. Board File Nos. 2646-00-HS and 2648-00-HS are applications to suspend the orders of the Inspector pending the hearing of the appeals from the Inspector’s orders. Board File No. 2941-00-HS is an appeal of the Inspector’s order. The Board, by decisions dated December 21, 2000, dismissed the applications for suspension of the Inspector’s orders in Board File Nos. 2646-00-HS and 2648-00-HS. The Registrar did not issue a notice of hearing in either of those two matters, nor does it appear from the file that the Registrar has issued a notice of hearing in Board File No. 2941-00-HS.
3Board File Nos. 2645-00-HS and 2647-00-HS are appeals of the Inspectors orders that were the subject of the applications for suspension in Board File Nos. 2646-00-HS and 2648-00-HS. The Registrar has issued notices of hearing in Board File Nos. 2645-00-HS and 2647-00-HS for June 20 and 21, 2001. Thus, it appears that counsel for the applicant had mistakenly referred to the applications for suspension rather than the appeals in describing which matters Inco wished to withdraw. The Board assumes from counsel’s letter that Inco wishes to withdraw its appeals in Board File Nos. 2645-00-HS, 2647-00-HS and 2941-00-HS, rather than the two applications for suspension that had been dismissed in December 2000.
4Therefore, the appeals in Board File Nos. 2645-00-HS, 2647-00-HS and 2941-00-HS are withdrawn at the request of the appellant.
5The Board by this decision is requesting that the Registrar advise the parties about the status of the proceedings in Board File Nos. 2933-00-HS and 3035-99-HS.
