Decision
1This is an employer review of an Order to Pay issued by an Employment Standards Officer.
2The hearing into this matter was scheduled for September 12, 2001 at 9:30 at the Board’s offices in Toronto.
3At the time scheduled for the hearing, the applicant was not in attendance. Accordingly, the Board, as its usual practice, stood down the hearing until 10:00 a.m.
4At 10:00 a.m. the Board reconvened. The applicant remained absent. Accordingly, the Board dismissed the application orally. This decision confirms that oral ruling.
Disposition
5The application is dismissed. The Board directs that the monies held by the Director in trust as wages be paid to the responding party, employee and that the administration fee thereon be paid to the Government of Ontario and Consolidated Revenue Fund.
