Ali Mahamat Abderamane v. CAW Local 1256
File No.: 2303-01-U Date: December 10, 2001
Before: Patrick Kelly, Vice-Chair
Decision of the Board
1The applicant endeavoured on November 14, 2001 to file an application alleging a violation of section 74 of the Labour Relations Act, 1995, as amended. The application contained an incomplete Certificate of Delivery (Form A-29). It appears from the Form A-29 that the applicant did not deliver a copy of the application and accompanying material to the responding party or to the employer.
2By letter dated November 20, 2001, the Registrar wrote to the applicant, advising that the application has not been processed because it does not comply with several of the Board’s Rules of Procedure.
3The Registrar’s letter further advised the applicant that if he wished to re-submit a properly complete application, he should do so within 10 days from the date of the letter or risk the possibility the application could be terminated.
4The applicant did not respond to the Registrar’s letter by re-submitting a complete application.
5The application is dismissed without prejudice to the filing of a fresh, properly completed application.
