1This is an employer appeal filed pursuant to section 68 of the Employment Standards Act against Order to Pay No. 55517 issued on January 30, 2001. The Order required the applicant employer to pay the sum of $4,646.15 to an employee, Mr. Ken Cavanagh, with the statutory administration fee of $464.61, making a total of $5,110.76.
2Mr. Cavanagh has conveyed to the Board that he no longer has any interest in the matter and that the money held in trust can be returned to the applicant employer.
3In the circumstances the amount of $5,110.76 held in trust by the Director of Employment Standards should be refunded to the applicant employer.
4The Ministry of Labour is a responding party to the application. It has ten working days from the date of this decision to request, if necessary, that this matter be re-listed for hearing.
DISPOSITION
5In the absence of a request described in paragraph 4, this matter shall be deemed to be terminated on the basis of the Director refunding to the applicant employer the sum of $5,110.76.
