3563-00-R Allied Construction Employees Local 1030, United Brotherhood of Carpenters and Joiners of America, Applicant v. Tyger Construction Inc., Responding Party v. Labourers International Union of North America, Ontario Provincial District Council; Carpenters and Allied Workers Local 27, United Brotherhood of Carpenters and Joiners of America; International Association of Bridge, Structural, Ornamental and Reinforcing Iron Workers, Local 721, Intervenors.
BEFORE: David A. McKee, Vice-Chair.
DECISION OF THE BOARD; June 14, 2001
1. The Intervenor, International Association of Bridge, Structural, Ornamental and Reinforcing Iron Workers, Local 721 (Iron Workers Local 721”) has requested that the Board amend the bargaining unit description in this application to delete all references to: “all rodmen and rodmen’s apprentices”. It relies on the agreement of the parties and the Board’s decision of May 10, 2001.
2. Iron Workers Local 721 is correct in that the Board has received no response from the Labourers’ International Union of North America, Ontario Provincial District Council to the May 10, 2001 decision. However, the Board notes that it has never determined the appropriate bargaining unit description in this application. In a decision dated March 8, 2001, the Board ordered a vote in a particular voting constituency. This voting constituency included references to rodmen and rodmen’s apprentices. The bargaining unit description has never been finalized.
3. Accordingly, the Board notes the agreement of the parties that any final bargaining unit description will not include a reference to rodmen and rodmen’s apprentices. The Board accepts this limitation as one which is appropriate in all the circumstances of this application.
