Decision
1By decision dated April 19, 2001 the Board set out its reasons as to why it was persuaded by the responding party that this matter ought to be dismissed without holding a hearing. The Board directed the applicant to file any submissions that he wished the Board to consider in connection with the issue no later than May 4, 2001. The deadline for the filing of submissions by the applicant was extended by Board decision dated May 10, 2001 to May 28, 2001. The Board’s May 10, 2001 decision was sent to the applicant by way of overnight courier.
2As of the date of this decision, the applicant has not filed any submissions as directed by the Board’s decisions of April 19 and May 10, 2001.
3For the reasons set out in the Board’s decision of April 19, 2001 the Board is persuaded that this matter ought to be dismissed on the basis of delay and on the basis that it fails to set out a prima facie case.
4This application is hereby dismissed.
