DECISION OF THE BOARD; June 11, 2001
1This matter is scheduled for hearing July 16 and 17, 2001.
2In its response Form A-78, the responding party has alleged that this application is "untimely and is sponsored by the employer".
3By fax dated February 8, 2001 the responding party alleges the "employer has coerced and intimidated the employees into making this application". The responding party states Mr. Joe Francesco met with employees and offered them money and other benefits in exchange for voting the union out.
4By letters dated June 1 and June 4, 2001 the intervenor requested that the responding party be ordered to provide full particulars with respect to the allegations of misconduct by the employer.
5Rule 38 of the Board's Rules of Procedure provides:
- Where a party in a case intends to allege improper conduct by any person, he or she must do so promptly after finding out about the alleged improper conduct and provide a detailed statement of all material facts relied upon, including the circumstances, what happened, when and where it happened, and the names of any persons said to have acted improperly.
6The responding party is directed to fully particularize its allegations, deliver them to the other parties and file them with the Board no later than June 22, 2001. The Board notes the responding party has not filed any unfair labour practice complaint.
7Any responses to the further particulars in this file must be delivered by July 6, 2001 to the Board and the other parties.
