The applicant has renewed her request for production of audiotapes and other documents related to the Hospital’s investigation into harassment in the workplace.
When this request was first made (at the outset of the hearing), I indicated that I was not satisfied that the requested material was arguably relevant to the issues in dispute. However, I advised the parties that I would revisit the issue, at the applicant’s request, should evidence be called that would establish arguable relevance.
The applicant has given evidence and the parties have filed written submissions on the issue. Based on the evidence and the parties’ submissions, I am satisfied that the Peterson tape, but no other tape, is arguably relevant. Accordingly, the Hospital is directed to make two copies of the Peterson tape and bring those copies, together with the original, to the hearing on Monday, May 28, 2001.
