DECISION OF THE BOARD; May 31, 2001
The Board is in receipt of a request for reconsideration from the United Food and Commercial Workers International Union (“UFCW”) of the Board’s decision of March 5, 2001. The request for reconsideration is dated April 5, 2001. The Board has not requested submissions from the responding parties.
The essence of the request for reconsideration is that the Board failed to answer the question put to it as to whether the collective agreement had been ratified in accordance with the Act. This question was indeed answered in the Board’s decision.
In paragraph 17, the Board stated that “the Board is not prepared to vacate the result of the ratification vote.” In that statement the Board makes an implicit finding that there was indeed a ratification vote. The Board continues and states at paragraph 18 that “the collective agreement was ratified”. There can be no question that the Board answered the question that it was asked and answered it in the affirmative.
A ratification vote was held and it was held in compliance with the Act.
