DECISION OF THE BOARD; November 8, 2001
1The Board is in receipt of the following correspondence:
(a) a letter from the counsel for the National Hockey League (the “NHL”), dated October 30, 2001, indicating that it intends to raise a preliminary issue in this matter regarding the jurisdiction of the Board and requesting that this issue be determined prior to the Board hearing evidence on this matter,
(b) a letter from the counsel from the applicant, Mr. Vincent Riendeau, dated November 1, 2001 indicating that his firm is no longer representing Mr. Vincent Riendeau, and
(c) a letter from the counsel for the National Hockey League Players’ Association (the “NHLPA”), dated November 6, 2001, in which it is indicated that the NHLPA supports the preliminary objection raised by the NHL and also seeks to have this objection determined prior to the merits.
2The Board will determine the preliminary objection and issue a decision on it prior to any inquiry into the merits of the application.
3Currently, there are four days scheduled for this matter. The hearing will convene on November 19, 2001 and continue on November 20, 2001, if necessary, to hear the preliminary objection to the jurisdiction of the Board. The hearing dates of November 30, 2001 and December 7, 2001 are cancelled. New hearing dates will be set if the preliminary objection is unsuccessful.
