This is an application for certification made pursuant to the construction industry provisions of the Labour Relations Act, 1995, S.O. 1995 ch. 1 (the “Act”). There are two main issues to be dealt with: the status of the applicant and the list. It is appropriate to deal with the first issue before getting into the considerably longer evidence and argument about the list (if indeed that issue needs to be addressed at all).
The Registrar is directed to set this matter down for hearing for one day to deal with the issue of whether the applicant is a trade union as defined in section 1(1) of the Act, or whether it is an affiliated bargaining agent of the designated Employee Bargaining Agency which includes the Labourers' International Union of North America and the Labourers' International Union of North America Ontario Provincial District Council, or any other issue with respect to the applicant’s status that has been raised to date.
