1The hearing scheduled for July 12, 2001 in Ottawa is hereby adjourned. The appeal will instead be heard in Toronto on August 16, 2001.
2By correspondence dated June 29, 20901 the applicant advised that he would not attend at the hearing scheduled for Ottawa, but asked that the Board proceed with the hearing and decide the application based on the documents filed.
3No documents have been filed with the Board other than the application and the decision of the Employment Standards Officer. The statements made in those documents cannot be admitted into evidence without proof, and would not in any event establish a foundation to reverse the decision of the officer that section 64.5(2) of the Act precludes the applicant from filing a complaint under the Act. Therefore the applicant should be aware that if he does not attend the scheduled hearing to adduce evidence in support of his right to bring a complaint, the application will be dismissed.
