The Board has considered the request of counsel for the responding party regarding the scrutinizer appointed by the applicant. The Board is not prepared to accede to the request that the Board order the removal of such scrutinizer. The vote is conducted under the auspices of a Board officer who is there to oversee the voting procedure. In such circumstances the Board will not interfere with the appointment of a scrutinizer by the applicant.
