DECISION OF THE BOARD
1This is an application to review Order to Pay No. 56721 issued on November 22, 2000.
2At the appointed start time for the hearing, no one was in attendance on behalf of the applicants. Accordingly and as is its usual practice, the Board stood the matter down in the event the applicants had been unavoidably delayed.
3However, when the hearing convened more then a half an hour after its scheduled start time, the applicants had still failed to appear. Accordingly, the hearing proceeded in their absence.
4In view of that absence, the parties who were in attendance moved that the application be dismissed and I indicated that I would issue a decision to that effect.
5This application is hereby dismissed and I note that there is consequently no subsisting impediment preventing the Director from paying out the monies being held in trust in this matter (along with any accrued interest thereon) in accordance with the terms of the Order to Pay.
