DECISION OF THE BOARD
1The responding party has now filed with the Board a response to this application, which response was not filed within the timelines stipulated by Rule 69 of the Board’s Rules of Procedure. In its response it indicates that no bargaining agent currently represents its employees “except that the employer is bound by his franchise agreement to respect the collective agreement herein attached.” No collective agreement was in fact attached to the response, and no name, address, telephone or facsimile number was provided therein. In the cover letter to the response, however, reference was made to “Local 57, FTQ”. Based on the foregoing it is unclear whether there is another trade union who may be affected by this application, and which has not had notice of this application.
2In all the circumstances, the Board directs that the ballot box in the representation vote directed by the Board’s decision dated July 25, 2001, be sealed until the Board orders otherwise, or the parties agree.
3The responding party is directed to immediately provide the Board in writing with the proper name, address, telephone number and facsimile number of the trade union that is signatory to the collective agreement referred to at paragraph 10 of its response.
