DECISION OF THE BOARD; September 28, 2001
Board File No. 1751-01-R is an application for certification in which a representation vote was directed by a decision of the Board (somewhat differently constituted) to be held on October 1, 2001.
On the same day but after that decision issued, the applicant filed an application under section 96 of the Labour Relations Act, 1995, R.S.O. 1995 (the “Act”). This is Board File No. 1789-01-U. The union indicates that, on the basis of the serious allegations contained therein, it intends to rely on section 11 of the Act in respect of the certification application.
The union asks that these two matters be consolidated or heard together. The certification application is currently scheduled to be heard on October 29 and 30, 2001. The Registrar is directed to list Board File 1789-01-U to be heard on the same dates as the certification application. The precise manner of proceeding in these two files will be determined by the panel scheduled to hear these cases.
The applicant has also requested that the ballot box be sealed pending further determinations in these matters. The Board sees no need or pressing reason to seal the ballot box and the applicant’s request in that regard is denied.
