DECISION OF THE BOARD; December 21, 2001
This is an application under section 43 of the Labour Relations Act, 1995 (the “Act”) for a direction that a first collective agreement be settled by arbitration. The parties have now consented to the Board issuing a direction that their first collective agreement be settled by arbitration.
The Board therefore finds that it appears that the process of collective bargaining has been unsuccessful and directs, pursuant to section 43(2) of the Act, that the collective agreement between the parties be settled by arbitration. The parties have agreed to have the matter settled by a board of arbitration pursuant to section 43(3).
