DECISION OF THE BOARD; July 6, 2001
1This is an application pursuant to section 68 of the Employment Standards Act as amended by the Economic Development and Workplace Democracy Act, 1998, S.O. 1998, c.8. The employer arranged for the issue of an irrevocable letter of credit to the Director of Employment Standards (“the Director”) in the amount of $11,550.00, which was accepted by the Director. The workplace parties have entered into Minutes of Settlement dated June 21, 2001. Having regard to the Minutes of Settlement, I hereby order:
that the employer forthwith pay to the Director in relation to this matter the sum of $6,000.00 which the Director shall disburse as follows:
(i) be paid to the Employee $5,000.00
(ii) to be paid as the administration fee to
the Government of Ontario
Consolidated Revenue Fund $1,000.00
2Upon receipt by the Director of the monies set out above, the Director is directed to release to the applicant the irrevocable letter of credit.
3The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
DISPOSITION
4In the absence of a request described in paragraph 3, this matter shall be deemed to be terminated.
