Decision of the Board
1This is an application for certification in the construction industry. A representation vote was held on May 8, 2001 and the ballot box was sealed. The applicant challenged all of the names on the voter’s list on the date of the hearing. Subsequently it changed its position and agreed that five individuals who voted were in the bargaining unit. The intervenor objects to the applicant changing its position and asks that the application be dismissed.
2The Board does not consider it appropriate to dismiss this application without a hearing. However, the intervenor may raise its objection at the hearing of the matter. As well as the issue raised by the intervenor it appears that there are still status issues in dispute as well as an 8.1 objection from the responding party.
3This matter will be referred to the Registrar to schedule a hearing.
