DECISION OF THE BOARD; August 30, 2001
Decision
1The Board, by decision in this application for certification dated August 27, 2001, directed the taking of a representation vote. The applicant, by letter to the Board dated August 28, 2001, requested leave of the Board to withdraw this application and that the Board cancel the representation vote that had been scheduled for August 29, 2001. The Registrar advised the parties by letter dated August 28, 2001 that the vote scheduled for August 29 and the meeting scheduled for September 19, 2001 had been cancelled.
2Having regard to the request of the applicant and to section 7(8) of the Labour Relations Act, 1995, S. O. 1995, c. 1, as amended (the “Act”), the Board hereby permits the applicant to withdraw this application.
3As this application is being withdrawn by the applicant before the representation vote was taken, the Board directs the parties’ and the employees’ attention to sections 7(9) and 7(9.1) of the Act. Should an application for certification be filed by the applicant within one year of the date of this decision, the effect, if any, of this decision and sections 7(9) and 7(9.1) of the Act on that subsequent application may be determined, if necessary, at that time.
