DECISION OF THE BOARD
This is an application under section 96 of the Labour Relations Act, 1995 (the "Act") alleging that the "Canadian Automotive Workers (CAW)" (referred to as the "union") and Mountain Springs Lodge have violated section 74. Section 74 of the Act does not apply to an employer and the application is hereby dismissed against Mountain Springs Lodge.
The union has failed to file a response and the applicant therefore asks that the matter be dealt with be the Board without a consultation. The Board does not consider it appropriate to determine this matter without a consultation. However, the union's failure to file a response may limit its ability to participate in that consultation.
This application is referred to the Registrar to schedule for consultation.
