DECISION OF THE BOARD; July 18, 2001
[1]. This is an appeal of an Order issued by the Inspector pursuant to section 57(5)(a) of the Occupational Health and Safety Act, R.S.O. 1990, c.O.1.
[2]. On the day scheduled for hearing in this matter, the applicant and the Ministry of Labour, with the assistance of a Labour Relations Officer, executed and filed Minutes of Settlement.
[3]. The agreement provides, inter alia, that the stop work order dated May 30, 2001 will, on the successful completion of certain steps, be suspended on an interim basis.
[4]. Having regard to the agreement filed with the Board, this matter is hereby adjourned sine die, for a period not to exceed one year. Unless any of the parties seeks to have the matter re-listed for hearing, it will be deemed to have been terminated upon the expiry of the one year period.
[5]. Any of the parties may seek to have the matter re-listed for hearing in accordance with the terms of their agreement.
