DECISION OF THE BOARD; July 12, 2001
[1]. This is an application for a review of a decision of an employment standards officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 ("the Act"). The applicant has filed an application for appeal and has submitted only part of the monies it was ordered to pay to the employee. It did not do so as it attributed the unpaid portion to statutory deductions from wages. An applicant is permitted to do so, provided it files a Breakdown of Statutory Deductions. The applicant has not done so. The Registrar directed the applicant to do so on or before July 6, 2001. It did not do so.
[2]. If the applicant has not filed a Breakdown of Statutory Deductions on or before July 25, 2001, this application will be dismissed and the Director will be ordered to pay out the monies held in trust. It is likely that the Employment Standards Branch will take steps to collect the balance.
