DECISION OF THE BOARD; June 29, 2001
1By correspondence dated June 27, 2001, counsel for the applicant in these matters noted that the responding party had not filed a response to these applications within the prescribed time. Counsel for the applicant further requested that the Board schedule these matters for hearing and make an order pursuant to Rule 42 that the responding party not be permitted to present any evidence or make any representations about the applications.
2On June 28, 2001, the responding party filed its responses to these applications with the Board. In its responses, the responding party raises preliminary objections that these applications should be dismissed on the ground that the Board should defer to the grievance procedure given that the subject matter of these applications is also the subject of a grievance.
3The parties may raise these preliminary issues with the panel of the Board assigned to hear these applications. The parties should nonetheless be prepared to proceed with the merits of these applications, if required, at that time.
4The Board directs that these applications be listed for hearing together. These matters are referred to the Registrar.
