1This is an application for a review of a decision by an Employment Standards Officer pursuant to section 67 of the Employment Standards Act, R.S.O. 1990, c.E-14 (“the Act”) in which the Officer refused to award public holiday pay. The order appealed from is a decision of Employment Standards Officer, Marlene Amos
2Mr. Winer gave evidence that indicated that he worked on December 24, 1999 and that, as a result, he was entitled to public holiday pay for December 25 and 26, 1999. He earned $100 per day.
3A hearing was held on June 15, 2001. No one appeared on behalf of the employer.

Decision
5Having regard to the uncontradicted evidence of Mr. Winer, I find that he is entitled to the following:
Public Holiday Pay $ 200.00
Total $ 200.00

6I order the employer to pay forthwith to the Director of Employment Standards, in trust, the amount of $200.00.
