DECISION OF THE BOARD; August 21, 2001
1The Board is in receipt of correspondence from counsel of the applicant dated August 17, 2001 in which the Board is asked to issue an order directing production from the responding party employer prior to first day of hearing in this matter. The hearing is scheduled for August 27 and 28, 2001.
2Upon reviewing the submission of counsel for the applicant the Board hereby directs the responding party employer to produce to the applicant on or before August 24, 2001 those documents set out in counsel for the applicant’s letter dated August 17, 2001.
3The Board further directs the responding party employer to advise the Board and the applicant no later than August 24, 2001 of those documents set out in counsel for the applicant’s letter of August 17, 2001 which are in their possession but have not been produced and the reasons why they have not been produced.
4If there is any dispute regarding the documents sought to be produced and/or the scope of production, the parties should be prepared to make submissions before the panel hearing this matter on August 27, 2001.
5The issue as to the order of procedure and any other procedural issue are left to the panel hearing this matter.
