1This is an employer application filed pursuant to Section 68 of the Employment Standards Act (the “Act”) requesting a review of an Order to Pay No. 60857 issued on July 26, 2001. The deadline for making this application is September 10, 2001. The application was filed on August 9, 2001.
2As of today’s date the Board has not received confirmation from the Director of Employment Standards that the requisite payment has been made or that the Director has accepted an irrevocable letter of credit with respect to the required payment pursuant to section 68(7) of the Act. That section provides as follows:
- (7) An application for a review of an order requiring the applicant to pay an amount is not properly made and the Board shall not proceed with the review unless, within the time for applying for the review, the applicant pays the amount to the Director in trust or provides the Director with an irrevocable letter of credit acceptable to the Director.
3The Director of Employment Standards is directed to advise the Board within 10 days from the date of this decision whether the applicant has complied with section 68(7) of the Act. The Board has no authority under the Act to proceed with this application for review without confirmation from the Director that the applicant has complied with section 68(7).
DISPOSITION
4If the Director does not confirm receipt of either the required payment or acceptance of a letter of credit within 10 days from the date of this decision, this matter will be terminated without any further notice to the parties.
