DECISION OF THE BOARD; June 19, 2001
- The parties have reached Minutes of Settlement and have requested that they be incorporated into an order of the Board. The Minutes of Settlement provide as follows:

MINUTES OF SETTLEMENT
WHEREAS the United Steelworkers of America (“USWA”) has been certified by the Ontario Labour Relations Board as the bargaining agent for the security guards employed by Carleton Condominium Corporation #25;
WHEREAS the Employer and the Union have been engaged in negotiations towards a first collective agreement, and;
WHEREAS the Union has been on strike since June 3, 1999;
IN CONSIDERATION OF A PAYMENT BY THE employer to the United Steelworkers of America in the amount of $5,780.00 (FIVE THOUSAND, SEVEN HUNDRED AND EIGHTY DOLLARS) to be distributed amongst Ray Markwick, Keith Neal, Dan Kingsley, Ali Sheik, Ali Jama Ali, Shawn Barry, and S. Columbe as set out in Schedule “A” hereto, and other valid consideration, the receipt and sufficiency of which is hereby acknowledged. THE PARTIES HERETO AGREE AS FOLLOWS:
The employment of each of Ray Markwick, Keith Neal, Dan Kingsley, Ali Sheik, Ali Jama Ali, Shawn Barry and S. Columbe by the Employer is terminated;
The USWA no longer wishes to be the bargaining agent for or represent the security guards employed by the Employer;
The USWA consents to the termination of its bargaining rights over the security guards of the Employer;
The parties hereto have at all times complied with the duty to bargain in good faith owed by each to the other;
The parties hereto jointly request and consent that this agreement be incorporated into an Order of the Ontario Labour Relations Board, and request that the Ontario Labour Relations Board issue a decision terminating the bargaining rights held by the USWA over the security guards employed by the Employer.
