1This is an employer appeal of an Order to Pay issued by an Employment Standards Officer.
2A hearing was scheduled to deal with the appeal in Windsor on April 10, 2001 at 9:30 a.m.
3At the hearing’s scheduled time, the applicant was not present. In accordance with its usual practice, the Board stood down for half an hour.
4At 10:00 a.m. the applicant was still not present. Accordingly, at that time the Board orally dismissed the appeal.
5This decision confirms that ruling.
6By letter dated April 20, 2001 counsel for the applicant advised that it had inadvertently failed to attend at the hearing scheduled for April 10, 2001 due to an error made by counsel’s office. The Board will treat this as a request for reconsideration of its oral decision of April 10, 2001.
7The applicant is directed to deliver a copy of its April 20, 2001 letter to the other parties. If either of the other parties wish to make submissions with respect to the request for reconsideration, such submissions must be filed with the Board by May 11, 2001.
