Decision
1Board file no. 0758-01-R is an application for certification in the construction industry. Board file no. 0841-01-U is an application under section 96 of the Labour Relations Act, 1995 alleging that the responding party engaged in unfair labour practices with respect to the certification application. A representation vote was held on June 14, 2001. On that date a representative of the applicant signed the Certification Worksheet indicating that Board file no. 0758-01-R should be dismissed. There is no reference to the section 96 application on the form. The Board subsequently received submissions in Board file no. 0758-01-R from the applicant objecting to the responding party’s conduct in failing to provide a list of employees in the bargaining unit as required by the Board’s rules but then presenting two employees at the vote. The submissions also refer to the section 96 application.
2In these circumstances the Board considers it appropriate to schedule both applications for hearing together. If there is any issue with respect to the Certification Worksheet it may be raised at the hearing.
