DECISION OF THE BOARD; April 24, 2001
1By decision dated March 27, 2001, a differently constituted panel of the Board adjourned this application sine die for a period of one year, subject to a request by any party that the Board proceed with this matter.
2In correspondence dated March 20, 2001, received by the Board on March 23, 2001, the applicant appears to request that the application be processed. It does not appear that the applicant delivered copies of this correspondence to the other parties in this matter. Subsequently, counsel for Edscha of Canada wrote to the Board asking that, in the event the application proceeded, the employer be given the appropriate time to file a response. A differently constituted panel of the Board confirmed by decision dated March 29, 2001 that Edscha of Canada shall have the time to respond as prescribed in the Board’s Rules of Procedure, should this matter be reinstated for hearing. That panel of the Board appears to have been unaware of the applicant’s March 20, 2001 request to process the application.
3The Board is now in receipt of a request by the responding party for an extension to file its response until April 27, 2001. In the circumstances, the Board is prepared to grant the responding party and Edscha of Canada ten days from the date of this decision to file and deliver their responses.
