Richard Porter, Applicant v. Gayle Porter, Kim Wilson Piper, Employment Standards Officer and Ministry of Labour, Responding Parties.
Before: Harry Freedman, Vice-Chair.
Decision of the Board: June 27, 2001
1The Board, by decision dated June 14, 2001 in this application for review under the Employment Standards Act, R.S.O. 1990, c. E. 14, as amended (the “Act”) of Order to Pay No. 61103 issued by Employment Standards Officer Kim Wilson Piper (the “Order”) found that the application had not been properly made because the applicant had not paid the entire amount of the Order to the Director; rather the applicant had paid more than half of the amount directly to the person on behalf of whom the Order was made, the applicant’s wife. As a result, the Board held that it could not proceed with the application unless the amount required by the Order was paid to the Director.
2The applicant has now advised the Registrar that he wishes to withdraw this matter. In his letter dated June 21, 2001 the applicant stated: “Please withdraw the appeal, keep the $1,000 that was the fees charged and release the rest to my wife.”
Disposition
3Having regard to the request of the applicant, this application is withdrawn.
