DECISION OF THE BOARD; September 14, 2001
The Board has received a letter from counsel for Lakeline Transportation Services dated September 12, 2001 in regards to a Board decision dated September 6, 2001.
In regards for dates for hearing, the Board would point out that a Notice of Hearing for Board File No. 1493-01-U was sent out dated September 6, 2001 which indicated that hearing dates in this matter would be on September 28, 2001, October 5, 2001, October 9, 2001 and October 12, 2001. By decision dated August 30, 2001 the Board directed this matter be scheduled with Board File Nos. 0759-01-U, 0760-01-U and 1021-01-U.
Counsel for Lakeline Transportation Services has raised issues relating to production and relating to the scheduled dates for hearing for File Nos. 0759-01-U, 0760-01-U and 1021-01-U. For the information of counsel for Lakeline Transportation Services, by Notice of Hearing dated August 13, 2001, File Nos. 0759-01-U, 0760-01-U and 1021-01-U were scheduled to be heard commencing on September 28, 2001. Counsel also has indicated that this matter should not be consolidated with the above files. Counsel asks that the September 6, 2001 decision be reconsidered and that his client only be directed to attend the hearing on September 28, 2001.
The Board is not prepared to reconsider its decision of September 6, 2001 or to make such directions as requested by counsel for Lakeline Transportation Services at this time. All matters raised by counsel’s letter dated September 12, 2001 may be raised with the panel assigned to hear this matter.
