1This is a director’s appeal filed in accordance with the relevant sections of the Employment Standards Act, R.S.O. 1990 e.E-14 as amended, (the “Act”) as it was in May 1997.
2The parties have reached a settlement dated April 17, 2001, the terms of which are as follows:
Re: Roger Lapworth, a Director for Don Baxi Agencies Inc.
v. Sharon Mott
OLRB File 2974-97-ES
Mr. Roger Lapworth will pay to Ms. Sharon Mott, on or before April 1, 2002 the sum of $19,440 in full and final satisfaction of Mr. Lapworth’s liability under Order to Pay D02177 made under the Employment Standards Act.
If the sum of $19,440 is not paid to Ms. Sharon Mott on or before April 1, 2002, it will be the responsibility of Ms. Sharon Mott to so advise the Ontario Labour Relations Board in writing on or before April 1, 2002. On receipt of such written advice from Ms. Mott, the Board will determine whether the funds were in fact not paid, and, if not, Order to Pay D02177 will be affirmed and may be enforced under the Employment Standards Act. If Ms Sharon Mott does not advise the Ontario Labour Relations Board in writing on or before April 1, 2002 that the settlement funds have not been paid, Order to Pay D02177 will be considered paid and and [sic] satisfied and the file of the Ontario Labour Relations Board will be closed.
