Decision of the Board
1These matters are an application under section 69 and 1(4) of the Labour Relations Act, 1995 (the "Act") and a referral of grievance to arbitration pursuant to section 133 of the Act. Prior to the hearing of these matters the parties entered into Minutes of Settlement dated July 26, 2001.
2Having regard to the Minutes of Settlement, the Board makes the following declarations:
the Board declares that Sipico Drywall Construction Ltd. and Tipico Drywall Construction are bound to the Residential Collective Agreement between Drywall Local 675 and the Interior Systems Contractors Association effective June 23, 1998 to April 30, 2001 (hereinafter referred to as the "ISCA Collective Agreement") and the Carpenters' Provincial Collective Agreement between the Carpenters' Employee Bargaining Agency and the Carpenters' District Council of Ontario, United Brotherhood of Carpenters and Joiners of America, effective May 1, 2001 to April 30, 2004 (hereinafter referred to as the "Carpenters' Provincial Collective Agreement");
the Board declares that Sipico Drywall Inc. and Frank Pietrangelo c.o.b. as Nu Trend Drywall are related employers within the meaning of section 1(4) of the Act to Sipico Drywall Construction Ltd. and Tipico Drywall Construction Ltd.;
having regard to the foregoing paragraph, the Board declares that Sipico Drywall Inc. and Frank Pietrangelo c.o.b. as Nu Trend Drywall are bound to the ISCA Collective Agreement and the Carpenters' Provincial Collective Agreement.
3The application that forms the basis of Board File No. 2567-00-R is withdrawn with leave of the Board as against Marsand Contracting Inc. Board File No. 2568-00-G is withdrawn with leave of the Board in its entirety.
