DECISION OF THE BOARD
1This is an application under section 96 of the Labour Relations Act, 1995 (the "Act") which alleges a breach of section 74 of the Act.
2The employer takes the position that it is Federally regulated and therefore the Board does not have jurisdiction over this application. By decision dated November 29, 2001 the Board directed the parties to file submissions with respect to this issue. Only the employer has done so.
3The employer advises that Teamsters Local 91 was certified by the Federal Labour Relations Board to represent its employees. It has also obtained extra-provincial trucking licenses. In view of these facts, the only ones before this Board, the Board finds that the employers' labour relations are Federally regulated. Accordingly, the Board does not have jurisdiction.
4This application is dismissed.
