DECISION OF THE BOARD; June 27, 2001
Reasons for Decision
1This is an application for certification that was filed on June 25, 2001. The time for the filing of the response is June 27, 2001.
2On June 26, 2001, the Board received correspondence from counsel for the responding party (“the employer”) requesting that, before filing its response, the applicant clarify its proposed bargaining unit, which is described in the application as follows:
all employees regularly employed for not more than 24 hours per week by the Town of Ajax, operations and environmental services department, recreation services department and all office, clerical and technical employees, save and except supervisors and persons above the rank of supervisor and persons for whom any trade union holds bargaining rights.
3On June 27, 2001, the union submitted a revised proposed bargaining unit as follows:
all employees regularly employed for not more than 24 hours per week by the Town of Ajax in the Town of Ajax, save and except Supervisors and persons above the rank of supervisors and persons for whom any trade union hold bargaining rights.
4In the circumstances, and given that the union’s initially proposed bargaining unit was capable of being interpreted in a number of ways, the Board hereby consents to the amendment of the application in respect of the proposed bargaining unit as set out in paragraph 3 above, and further grants the employer an extension to file its response to the application to no later that 5:00 p.m., Friday, June 29, 2001.
5The date of the representation vote, if any, shall be dealt with by the panel of the Board assigned to deal with that issue.
