DECISION OF THE BOARD; August 30, 2001
This is an application for certification in the construction industry. I am reviewing this file as part of a general effort at the Board to look at old files that are still open. In this case, it appears that the Board failed to give effect to the results of a representation vote held, in accordance with the parties’ Minutes of Settlement. The purpose of this decision is to do what the Board should have done in April 1999.
In a decision dated March 17, 1999, the Board directed that a representation vote be held, pursuant to the parties’ Minutes of Settlement, dated March 17, 1999. The parties agreed on a voter’s list, and further agreed that the outcome of the presentation vote would determine the outcome of the application for certification.
On the taking of the representation vote, fewer than fifty per cent of the ballots cast were in favour of the applicant. In accordance with the parties Minutes of Settlement, the Board hereby dismisses this application.
Given the passage of time, there is little to be gained from posting this decision in the workplace, and so I decline to so order.
The Board will destroy the ballots cast in the representation vote following 30 days from the date of this decision unless one of the parties requests in writing, that the Board not destroy the ballots.
