DECISION OF THE BOARD
1This purports to be an application under the Public Sector Labour Relations Transition Act, 1997 (the “Act”). The applicant complains that a collective agreement negotiated between a trade union and a school board, after that school board assumed jurisdiction for a predecessor board, contains provisions that are detrimental to her. The applicant has been on long term disability for many years and says that under the new collective agreement she is required to pay her benefit premiums. She says that under the prior collective agreement her premiums were paid by the school board.
2The Act does not confer jurisdiction upon the Board to determine a complaint of this nature from an individual. It is possible that the applicant might have some recourse through the trade union under her collective agreement or through other legislation or in another forum. It is not possible to guess where recourse, if any, might lie with so few facts. It is certain however, that the Board does not have jurisdiction with respect to this matter as it is currently framed or under the Public Sector Labour Relations Transition Act, 1995. The application is therefore hereby dismissed.
