DECISION OF THE BOARD; April 26, 2001
[1]. The Board made a decision in this matter on March 7, 2001, following a settlement by the parties. At the time, the applicable deductions pertaining to the money owed to Mr. Wood were not known. This decision deals with the final calculation of the amounts owed to Mr. Wood.
[2]. The Board is now in receipt of a letter dated April 5, 2001 from counsel representing the applicant, Red Star Electric Limited. Counsel indicates that the recalculated deduction from the sum owed to Mr. Wood is $1,078.13 for statutory deductions and $1,333.94 for the Family Support Plan. The total of these amounts is $2,412.07.
[3]. The applicant originally withheld $3,289.98, a figure which is now known to be too much in view of the parties’ settlement. Accordingly, assuming the Board correctly understands counsel’s letter, Red Star Electric Limited is to remit directly to Mr. Wood the difference between these amounts ($3,289.98 minus $2,412.07 equals $877.91). The Director of Employment Standards will remit to the parties forthwith the amounts already specified in the Board’s decision of March 7, 2001, if he has not already done so.
