DECISION OF THE BOARD; June 8, 2001
This is a successor rights application pursuant to section 68 of the Labour Relations Act, 1995, S.O. 1995, c. 1, as amended (the “Act”).
A hearing was held on June 8, 2001.
Notice of this application has been sent to the responding party employer. In addition notices in Form B-15 have been posted on the employer’s premises in conspicuous places where they would most likely come to the attention of any individual potentially affected by this application. The notices specify that anyone wishing to make representation to the Board should send the Board a statement to this effect, in writing. As of the date of hearing, no intervention or statement of objection or opposition has been filed by any individual.
Based on a review of the material before it, and based on submissions of the parties the Board hereby declares that the CAW Local 448 of the National Automobile, Aerospace, Transportation and General Workers’ Union of Canada (CAW-Canada) has acquired the rights, privileges and statues of its predecessor, Retail Wholesale Canada, Canadian Service Sector Division of the United Steelworkers of America, Local 448 by reason of a merger, amalgamation or transfer of jurisdiction.
