DECISION OF THE BOARD; October 9, 2001
1This is an application brought pursuant to the Employment Standards Act seeking to review a decision of an Employment Standards Office not to issue an order to pay.
2Prior to the hearing the parties entered into Minutes of Settlement.
3The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
4As part of the settlement the employer undertook to remit a certain sum to the applicant on or before October 5 2001. It was agreed that failure to pay would result in the resumption of this application.
DISPOSITION
- If the Board has not heard from the applicant on or before October 18, 2001, this application shall be deemed to be terminated.
