Employment Practices Branch File No. 22023139
BEFORE: Marilyn Silverman, Vice‑Chair.
DECISION OF THE BOARD; December 17, 2001
1This is an employee appeal of a decision of an employment standards officer.
2By letter dated August 17, 2001 Employment Standards Officer, Martha Einarson, issued a letter advising the applicant that after investigation it was determined that no monies were owing in his claim. The applicant filed an application for review of that decision on November 14, 2001.
3In this case in order for the application for review to have been timely it should have been filed by October 1, 2001; that is within 45 days of the date of the August 17, 2001 letter.
4By letter dated November 27, 2001 the Registrar advised the applicant that his application for review was late and that he could request an extension of time for filing the application from the Board within ten (10) days of the Registrar’s latter. That ten (10) day period ended December 11, 2001. No request for extension has been made.
5Having regard to the circumstances described above, this application is hereby terminated.
