DECISION OF THE BOARD; August 16, 2001
This is an application for review under section 68 of the Employment Standards Act, R.S.O. 1990, c. E.14, as amended (“the Act”) of Order to Pay No. 61252 issued by Employment Standards Officer Cheryl Starr on June 13, 2001 (“the Order”).
The application was initially filed on an incorrect form. The Board sent a fresh package to the applicant so that the correct form could be submitted. The applicant has now submitted the correct form of the application, but the application has been received two days late. It should have been received on August 14, 2001. It was received on August 16, 2001. The correct form was mailed to the Board on August 14, 2001.
The period of lateness is small. There is no prejudice to the responding parties by the delay. The applicant has clearly shown an intention to seek review of the Order by the submission of an earlier timely application. It mailed this application within the time permitted for its filing. In these circumstances the Board will extend the period for the filing of the application until August 16, 2001.
