1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990, c.E-14, as amended (the "Act") for a review of an Order to Pay issued on February 7, 2001. The application for review was filed with the Board on March 28, 2001. The application is therefore untimely in accordance with section 68(3) of the Act.
2Section 68(4) permits the Board to extend the time for the filing of an application if it considers it advisable to do so. The applicant has requested the Board to exercise its discretion to extend the time for filing of this application and has provided submissions in support of its request. Having considered the submissions of the applicant, the Board considers that this is an appropriate case in which to exercise its discretion and extend the time for the filing of the application for review.
3The Board hereby extends the period in which to file an application for review to March 28, 2001. This application is therefore timely.
